Terms of Service

These terms govern your use of NovaraFit during its public beta. By creating an account, you agree to them.
1. Beta status
NovaraFit is currently in public beta. Features, the Readiness Score algorithm, AI credit allowances, and gamification mechanics may change, be added, or be removed without prior notice. Bugs and downtime are more likely during this phase than in a stable release, and we may reset certain data (such as XP or streaks) during major beta updates if needed.
2. Eligibility & accounts
You must be at least 16 years old to create a NovaraFit account. You're responsible for the accuracy of the information you provide and for keeping your account credentials secure. Let us know immediately if you suspect unauthorized access to your account.
3. Not medical advice
NovaraFit — including the Readiness Score, progression suggestions, and AI coaching chat — provides general fitness information and is not a substitute for professional medical advice, diagnosis, or treatment. Talk to a physician before starting a new training program, especially if you have an existing injury, condition, or health concern. You're responsible for how you use the app's suggestions and for stopping a session if something feels wrong.
4. AI features & credits
AI plan generation and AI coaching chat are subject to usage limits enforced server-side through the credits system. Credit allowances may change during the beta. AI-generated responses are produced automatically and may occasionally be inaccurate or generic — use your own judgment, particularly around training intensity and injury risk.
5. Acceptable use
Don't attempt to reverse-engineer, abuse, or overload the service; don't use automated tools to exhaust AI credits; don't misuse the AI coach to generate content unrelated to training; and don't attempt to access other users' data.
6. Your content
You retain ownership of the training data and messages you enter into NovaraFit. You grant us the limited right to process this data to operate the app's features, as described in our Privacy Policy.
7. Intellectual property
The NovaraFit app, its design, and its underlying software are the property of NovaraFit Kalbermatter. Nothing in these terms transfers ownership of that software to you.
8. Termination
You can delete your account at any time from within the app. We may suspend or terminate accounts that violate these terms, misuse AI features, or pose a security risk to the service.
9. Disclaimer & limitation of liability
The app is provided "as is" during the beta, without warranties of any kind, express or implied. To the maximum extent permitted by law, NovaraFit Kalbermatter is not liable for indirect, incidental, or consequential damages arising from your use of the app, including any injury resulting from following a training suggestion, plan, or AI-generated recommendation. Nothing in these terms limits liability for gross negligence, willful misconduct, or death or personal injury caused by our proven fault, where such limitation is not permitted by law.
10. Changes to these terms
We may update these terms as the app evolves — particularly once payment plans are introduced. We'll notify you of material changes in-app before they take effect.
11. Governing law
These terms are governed by Swiss law. The place of jurisdiction is Solothurn, Switzerland, to the extent permitted by mandatory consumer-protection law in your place of residence.

These terms are a starting point for the NovaraFit beta and are not a substitute for legal advice. We recommend having them reviewed by a qualified Swiss lawyer before public launch, particularly once payments and subscriptions are introduced.
